IMPORTANT UPDATE: Delays Expected Due to Hurricane Fiona (posted 09/19/2022)

Due to Hurricane Fiona in Puerto Rico we expect to see delays over the coming days as the majority of the island is without electricity and water. Government offices will be closed today, but the plan is to re-open tomorrow with auxiliary power if necessary.

We will monitor very closely and will update you if we see delays extending.

Due to the recent political turmoil and active situation occurring in the Ukraine, many service requests are suspended at this time.

What is it
ESR has developed a tool that allows clients that use the ESR manual background check ordering solution to upload signed, mandatory background check related documents at the time the order is entered.

IMPORTANT UPDATE: Drug Testing Laboratory Update (posted 04/18/2022)

Quest
Quest is not reporting delays currently. Processing and negative screening is working same day. Confirmation reporting has returned to average time of 3 to 5 days.

Collection kit fulfillment has slightly improved. Receipt of products is now tracking at 20 days from time of request. Quest expects to return to 7 to 10 business day window within the next two weeks.

LabCorp
LabCorp continues to face operational challenges. However, there has been some improvement. Negative specimens have returned to normal reporting times of 24-48 hours after receipt at the laboratory. On average, non-negative reporting still holds at 10 to 14 days. In extreme cases, reporting of non-negatives can take up to 30 days. However, over the past two weeks, ClearStar's non-negative results are reporting on average of just over 8 days after receipt at lab. LabCorp has added new employees to support incoming specimen volume and will continue to hire additional employees as needed. Mandatory overtime is still in effect to mitigate the specimen backlog.

Some LabCorp PSCs are experiencing kit shortages due to order fulfillment constraints. LabCorp is working to send out controlled amounts of kits to PSCs from their warehouse supply but maintain that most PSC orders come directly from the vendor. The vendor is backlogged currently, reporting delays of 4 to 6 weeks.

Alere
No testing or reporting delays currently.

Alere continues to adjust some product orders to reflect client’s current usage. This is being done to help manage inventory and meet the ordering needs of all their clients. Thus far, ClearStar orders have not been impacted by this change. Orders are being fulfilled as ordered.

IMPORTANT UPDATE: Michigan I-CHAT and Court Updates (posted 03/31/2021)

ESR Previously notified clients about a decision to move our clients primarily to the Michigan State Police criminal record source, the Michigan I-CHAT, due to a court decision that would limit reportability of records returned by individual counties.

At this time, our access point to the records at a county level is being restored to what ESR previously offered before this change.

What change occurred?
ESR's supplier for Michigan criminal records has been approved by Michigan's State Court Administrative Office (SCAO) as Authorized Individuals.

What does this change mean?
Authorized Individuals as defined by the SCAO are permitted to access records and obtain information that was previously limited by the court order, restoring the level of service that ESR had prior to the courtâs decision.

IMPORTANT UPDATE: Michigan I-CHAT Update (posted 11/08/2021)

ESR previously notified clients regarding the decision by the Michigan Supreme Court to redact Dates of Birth (DOB) from Michigan court records effective January 1, 2022. Since that notification, ESR has learned that several courts in Michigan have begun to redact DOB information from their records in advance of the deadline with little or no notice. Without adequate identifiers, CRAs like ESR cannot meet the maximum possible accuracy requirement of the FCRA.

WHAT ESR IS DOING
ESR has done extensive research on Michigan's I-CHAT system, including having several phone conversations with the I-CHAT Coordinator for the Michigan State Police. During those conversations, ESR was assured that all Michigan courts are mandated to report criminal case information to the I-CHAT system. Meaning, all relevant case information (including DOB) will be accessible via this system.

As a result of the action by Michigan counties and the information provided to ESR by the Michigan State Police regarding the completeness of the records they hold, ESR will begin processing all Michigan county criminal searches via the statewide I-CHAT system effective November 12, 2021. This means that for each candidate, ESRâ's system will automatically drop any county-level searches from the candidate's profile and replace them with a single Criminal Statewide screening which will cover Michigan statewide. Therefore records from all Michigan counties will be searched, not just where the applicant has resided, worked, or studied.
